These Terms of Use (“Terms”) are a binding agreement between you and Anna Baker, an individual operating buddy as a sole-proprietor product (“buddy,” “we,” “us”) located in Florida, United States. By signing in, creating an account, or otherwise using buddy you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the app.
buddy is a personal-productivity tool for field sales representatives and their managers. It organizes accounts, contacts, visits, pipeline, goals, planner events, and related working notes. It is not a system of record, a regulated medical device, an electronic health record, or a CRM of record for any employer, and its output should not be relied upon for regulated or clinical decisions.
You must be at least 13 years old to use buddy. If you are between 13 and 18 you may use buddy only with the involvement of a parent or legal guardian who accepts these Terms on your behalf. By using buddy you represent that you meet these requirements.
You are responsible for the accuracy of the information you enter, the security of your PIN, the security of the device or devices you use to access buddy, and all activity that occurs under your account. If you suspect your PIN or device has been compromised, reset your PIN through the in-app recovery flow and contact us immediately.
You agree not to:
buddy, including its source code, design, branding (including the buddy face mark), documentation, and the aggregate arrangement of its features, is owned by Anna Baker and is protected by United States and international intellectual-property laws. You receive a limited, personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. You retain ownership of the content you enter; by entering it you grant us a limited license to store, transmit, and display it as necessary to operate the service for you.
buddy relies on third-party services, including Google Firebase, Anthropic, Vercel, and GitHub Pages, as described in the Privacy Policy. Your use of buddy is also subject to those providers’ terms. We do not control and are not responsible for their actions.
The buddy-AI feature returns text generated by a language model. Output may be inaccurate, incomplete, or outdated. Verify anything material before acting on it. Do not rely on AI output for regulated, clinical, legal, or financial decisions. You are solely responsible for the actions you take in reliance on AI output.
buddy is provided on a best-effort basis. We may modify, suspend, or discontinue any part of the service at any time. We may update these Terms at any time; material changes will be announced in-app and will take effect after the effective date stated at the top of the document. Your continued use after that date constitutes acceptance.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ANNA BAKER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA WILL NOT BE LOST.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ANNA BAKER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF ANNA BAKER ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100), regardless of the cause or theory of liability.
You agree to defend, indemnify, and hold harmless Anna Baker from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your misuse of the service, your entry of Protected Health Information, or your violation of any law or the rights of a third party.
You may stop using buddy at any time by deleting your data in Settings. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your continued use poses a risk to the service or to other users. Sections intended to survive termination (including Ownership, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute not subject to arbitration is the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.
We prefer to resolve concerns informally. Before filing any formal claim, contact us through the in-app feedback form and give us 30 days to respond. Any claim not resolved informally must be brought within one year after it arose. Class actions, class arbitrations, and representative actions are not permitted.
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Anna Baker regarding buddy and supersede any prior agreements. Our failure to enforce a provision is not a waiver of our right to enforce it later.
